Consumer Rights

GENERAL:

1. If you place an order electronically through the website you are using, you are deemed to have accepted the pre-information form and the distance sales contract presented to you.

2. Buyers are subject to the provisions of the Law on Consumer Protection No. 6502 and the Distance Sales Regulation (Official Gazette: 27.11.2014/29188) and other applicable laws regarding the sale and delivery of the product they purchase.

3. Shipping costs for product delivery will be paid by the buyers.

4. Each purchased product is delivered to the person and/or organization at the address indicated by the buyer, provided that it does not exceed the legal period of 30 days. If the product is not delivered within this period, buyers may terminate the contract.

5. The purchased product must be delivered complete, in accordance with the specifications stated in the order, and with documents such as a warranty certificate and user manual, if any.

6. If the sale of the purchased product becomes impossible, the seller must notify the buyer in writing within 3 days of learning of this situation. The total amount must be refunded to the Buyer within 14 days.

IF THE PURCHASED PRODUCT PRICE IS NOT PAID:

7. If the Buyer does not pay the price of the purchased product or cancels it in the bank records, the Seller's obligation to deliver the product ceases.

PURCHASES MADE WITH UNAUTHORIZED CREDIT CARD USE:

8. If it is determined after the product is delivered that the credit card used by the buyer for payment has been used unfairly by unauthorized persons and the product price is not paid to the Seller by the relevant bank or financial institution, the Buyer must return the product subject to the contract to the SELLER within 3 days, with the shipping cost belonging to the SELLER.

IF THE PRODUCT CANNOT BE DELIVERED ON TIME DUE TO UNFORESEEABLE REASONS:

9. If unforeseen force majeure events occur and the product cannot be delivered on time, the Buyer is informed. The Buyer may request cancellation of the order, replacement of the product with a similar one, or postponement of delivery until the obstacle is removed. If the Buyer cancels the order; if the payment was made in cash, this amount will be paid back to them in cash within 14 days of cancellation. If the Buyer paid with a credit card and cancels, the product price will be refunded to the bank within 14 days, but it is possible for the bank to transfer it to the buyer's account within 2-3 weeks.

BUYER'S OBLIGATION TO INSPECT THE PRODUCT:

10. The Buyer shall inspect the goods/services subject to the contract before receiving them; dented, broken, torn packaging, etc. The Buyer shall not accept damaged and defective goods/services from the shipping company. It will be accepted that the received goods/services are undamaged and sound. The BUYER is obliged to carefully protect the goods/services after delivery. If the right of withdrawal is to be exercised, the goods/services must not be used. The invoice must also be returned with the product.

RIGHT OF WITHDRAWAL:

11. The BUYER may exercise the right of withdrawal from the contract by rejecting the goods without any legal or criminal liability and without stating any reason, provided that they notify the SELLER via the contact information below within 14 (fourteen) days from the date of delivery of the purchased product to themselves or to the person/organization at the address indicated.

DURATION OF THE RIGHT OF WITHDRAWAL:

13. If the product purchased by the Buyer is a service, this 14-day period starts from the date the contract is signed. The right of withdrawal cannot be exercised in service contracts where the performance of the service has started with the consumer's consent before the expiration of the right of withdrawal period.

14. The expenses arising from the exercise of the right of withdrawal belong to the SELLER.

15. For the exercise of the right of withdrawal, a written notification must be made to the SELLER by registered mail, fax or e-mail within 14 (fourteen) days and the product must not have been used within the framework of the "Products for which the Right of Withdrawal cannot be exercised" provisions regulated in this contract.

EXERCISING THE RIGHT OF WITHDRAWAL:

16. The invoice for the product delivered to a 3rd party or the BUYER, (If the invoice of the product to be returned is corporate, it must be sent with the return invoice issued by the institution. Order returns for which invoices are issued in the name of institutions cannot be completed unless a RETURN INVOICE is issued.)

17. The return form, the box, packaging, and standard accessories of the products to be returned, if any, must be delivered complete and undamaged.

RETURN CONDITIONS:

18. The SELLER is obliged to refund the total amount and the documents that obligate the BUYER to the BUYER within a maximum of 10 days from the date of receipt of the withdrawal notification and to take back the goods within 20 days.

19. If there is a decrease in the value of the goods due to a fault of the BUYER or if the return becomes impossible, the BUYER is obliged to compensate the SELLER's damages in proportion to their fault. However, the BUYER is not responsible for changes and deteriorations that occur due to the proper use of the goods or product within the right of withdrawal period.

20. If the campaign limit amount organized by the SELLER falls below due to the exercise of the right of withdrawal, the discount amount benefited from within the scope of the campaign will be canceled.

PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE EXERCISED:

21. Products prepared in line with the BUYER's request or explicit personal needs and not suitable for return, lower underwear, swimwear and bikini bottoms, make-up products, disposable products, products that are likely to spoil quickly or expire, products whose packaging has been opened by the BUYER after delivery and are not suitable for return due to health and hygiene reasons, products that mix with other products after delivery and cannot be separated due to their nature, goods related to periodicals such as newspapers and magazines, except those provided under a subscription contract, services performed instantly in electronic environment or intangible goods delivered instantly to the consumer, and audio or video recordings, books, digital content, software programs, data recording and data storage devices, computer consumables, if their packaging has been opened by the BUYER, cannot be returned according to the Regulation. In addition, it is not possible to exercise the right of withdrawal for services whose performance has begun with the consumer's consent before the expiration of the right of withdrawal period, according to the Regulation.

22. For cosmetic and personal care products, underwear, swimwear, bikinis, books, copyable software and programs, DVDs, VCDs, CDs and cassettes, and stationery consumables (toner, cartridge, ribbon, etc.) to be returned, their packaging must not be opened, tried, spoiled or used.

DEFAULT AND ITS LEGAL CONSEQUENCES

23. In the event that the BUYER defaults if they make payment transactions with a credit card, they accept, declare and undertake that they will pay interest within the framework of the credit card agreement with the card-holding bank and will be responsible to the bank. In this case, the relevant bank may resort to legal remedies; it may demand the resulting expenses and attorney's fees from the BUYER and, in any case, if the BUYER defaults on their debt, the BUYER agrees to pay the loss and damage incurred by the SELLER due to the delayed performance of the debt.
